Privacy of personal information

Fondaction is committed to protecting people’s privacy and ensuring the confidentiality of the personal information it collects, holds and uses in the course of its business relationships with its stakeholders.

To this end, the Fund has adopted the Protection of Personal Information and Privacy Policy (the “Policy”), which is governed by the Act respecting the protection of personal information in the private sector. In this context, personal information refers to information concerning a natural person that directly or indirectly allows that individual to be identified.

For whom is the privacy policy intended?

The Policy applies to all Fondaction activities and to anyone who interacts with the Fund, whether, for example, as a shareholder, website user or job applicant

Collection

Fondaction limits the collection of personal information to what is reasonably required to fulfill the purposes for which it was obtained.

Here are some of the sources from which personal information is collected:

  • directly from the individual, for example when applying, subscribing for shares or submitting an online form;
  • from a third party, such as an employer or a financial institution;
  • through cookies, which are stored when you browse the website.

Individuals are not required to provide Fondaction with their personal information when requested, but Fondaction may not be able to provide them with certain products and services or to process an application, including issuing Fondaction shares to such individuals.

Use

This information is used, among other things, to create and manage an account and to confirm a person’s identity. Obtaining certain personal information may also be required to prevent fraud and financial crime.

Fondaction may use personal information for its general purposes, such as:

  • providing or delivering products and services or handling applications;
  • enhancing customer experience and improving or developing its range of products and services, including the use of the website.

Is my personal information shared with third parties?

Fondaction may communicate personal information to third parties, such as mandataries and service providers, in order, for example, to prepare investment statements or tax slips, or to scan and store documents.

When Fondaction communicates personal information to third parties, it stipulates by contract, in accordance with the law, that the personal information communicated must be used only for the purposes of fulfilling the contract and that it must benefit from reasonable protection measures, taking into account, for example, its sensitivity, use or quantity.

Fondaction may also communicate personal information where permitted or required by law, such as to the Canada Revenue Agency or to Revenu Québec for tax purposes, or to fraud prevention agencies.

Requests for access or other interventions

With the exception of specific cases, such as a request to update a shareholder file, all requests for access, rectification, modification or deletion, as well as any complaints regarding the protection of personal information, must be submitted in writing to the person in charge of the protection of personal information as indicated below::

The person in charge of the protection of personal information shall respond promptly to any request submitted to them, generally within 30 days of receiving the written request. If this person is unable to respond to a request, in whole or in part, the reason is to be provided to the individual who made the request.
